New Changes to YouTube’s Terms of Service
YouTube has updated its Terms of Service for U.S. and non-U.S. users
New changes to YouTube’s terms of service was announced today, November 18, 2020, and these terms takes effect immediately for users in the U.S.
YouTube apparently wants to clarify their service terms and provide transparency to their users.
Here are the statements made by YouTube on their change of the terms of service:
“At YouTube, we periodically update our Terms of Service to make sure they are clear, easy to understand and meet the needs of our partners, advertisers and viewers.
With this update to our Terms of Service, we’re clarifying restrictions around the collection of facial recognition data. We also want to be transparent with you about the rights we take to run ads in various areas of our platform. For example, we run ads on videos, the homepage masthead, and in various search results. This update also clarifies how revenue payments from YouTube will be considered royalty payments from a U.S. tax perspective, and that Google will withhold taxes from these payments as required by law.”
Here’s a summary of the changes:
Facial recognition restrictions: The Terms of Service already state that you cannot collect any information that might identify a person without their permission. While this has always included facial recognition information, the new Terms make that explicitly clear.
YouTube’s right to monetize: YouTube has the right to monetize all content on the platform and ads may appear on videos from channels not in the YouTube Partner Program.
Royalty payments and tax withholding: For creators entitled to revenue payments, such payments will be treated as royalties from a U.S. tax perspective and Google will withhold taxes where required by law.
Note that YouTube says, if you allow your child to use YouTube Kids, then you also agree to the new Terms on behalf of your child.
YouTube stated the above changes shouldn’t significantly alter our access or use of the YouTube service.
YouTube reminds that by continuing to use YouTube in the U.S. after this date (November 18, 2020), you agree to the new Terms. Note that similar changes to their Terms of Service will be made outside the U.S. in 2021.
